Abstract

This paper examines the institute of internment for protective purposes, the case of children placed in care institutions, in order to outline the limits of state action and the demands that fall on the institutions involved in this momentous resolution. For this, we frame the different modalities that internment exhibits in Chilean legal regulations, we analyze the principles, justifying elements and requirements that underlie its application. The examination of the requirements produces proposals for the judge who must make the decision and for the evaluation of the institutionalization decision by litigants or hierarchical superiors. Then the various control mechanisms of this institute are reviewed and some regulations related to this specific protection measure are enunciated. In this way, we hope to offer a framework for examining protective internment that, together with allowing its scrutiny, contributes to its better application.
